Understanding Legal Aid
Legal aid is a means-tested form of financial assistance provided by the Scottish Legal Aid Board (SLAB) to help cover legal costs for those who qualify. During our initial consultations, we discuss the possibility of legal aid eligibility with every client. The process involves:
- Gathering Documentation
Clients need to provide:- Recent bank statements
- Wage slips
- A detailed breakdown of weekly/monthly outgoings
- Benefits letters (if applicable)
- Application Submission
Once we have the required information, we submit the legal aid application to SLAB via their online portal. The process is two-fold:- Means Test: Determines if the applicant qualifies based on income and outgoings.
- Merits Test: Assesses if the case justifies legal aid, considering the interests of justice.
While we assist with the application, the final decision rests with SLAB.
When Legal Aid Is Refused

- Block Fee Agreements
Rather than billing for every call or meeting, we agree on a single, upfront fee covering all preparation stages, with additional costs (if any) discussed in advance. - Instalment Payments
To ease financial pressure, we provide the option to pay fees in instalments over several months. The only requirement is that fees be settled in full by the case’s conclusion.
