Selling Property in Scotland

Our conveyancing solicitors are based in Glasgow and can handle all aspects of the conveyancing in respect of your house sale in Scotland.

Once we receive an offer, we’ll communicate this to you, indicating whether or not it is something we would regard as acceptable. Even if the price is acceptable, other elements are usually unacceptable. Thus, we send back a qualified acceptance to the prospective purchaser’s solicitor and negotiate with them over the price; the date of entry; what items (if any) are to be included in the price; any repairs which are to be carried out and other matters. This process is known as the missives and forms the contract of sale.

It’s also important when selling a property to discharge the mortgage. As solicitors, we will handle this part of the transaction for you. This must be done in order that ‘title’ to the house can pass to the new buyer. Call us today for a free confidential chat. There’s no obligation. Or you can use our online enquiry form and one of our conveyancing solicitors will contact you as soon as possible.

YOUR QUESTIONS ANSWERED

Selling a Property FAQs

Before selling your home, it is now mandatory to instruct a home report. These are instructed by you, the seller, on behalf of potential buyers. They last for 12 weeks before it becomes necessary to instruct a new one. Purchasers may also instruct their own survey to ensure they are happy with the property.

Home reports comprise three documents: a Single Survey, an Energy Report and a Property Questionnaire. The Single Survey is an assessment of the condition of the home, its likely value and how accessible it is prepared by a chartered surveyor. The Energy Report is a survey of the energy efficiency and energy consumption of the property, with recommendations for improvement. It also contains details of emissions etc. The Property Questionnaire is completed by the seller and contains information which is useful to potential buyers such as factoring costs and council tax banding.

As stated above, these are mandatory if you are selling a property, and they last for a finite period. If you are selling your home contact us today. Call us today on 0141 471 9278 for a free confidential chat. There’s no obligation.

When selling a property in Scotland, sellers should budget for several costs, including estate agent fees, conveyancing fees, and the Home Report, which includes a survey, energy performance certificate (EPC), and property valuation. Additionally, sellers might need to pay off any outstanding mortgage, which could involve early repayment fees. It’s crucial to discuss these costs with your solicitor and estate agent to have a clear understanding of the financial implications.

The time it takes to sell a property in Scotland can vary depending on market conditions and the complexity of the transaction. On average, it can take anywhere from 6 to 12 weeks from the date the property is listed for sale until the completion date. However, it’s important to note that certain factors, such as securing a buyer and finalising legal documentation, can influence the timeline.

While it is possible to sell a property without a solicitor, it is highly recommended to engage a qualified conveyancing solicitor to handle the legal aspects of the transaction. A solicitor ensures that all legal requirements are met, prepares the necessary documentation, and provides guidance throughout the process, protecting your interests and ensuring a smooth sale.
