Fixed rate fees for Executries

Confirmation only

Testate Estates

Where the Confirmation is required only in relation to the sale of a property, there are no other assets and there is legally valid Will

Fees start from £995 plus vat and outlays

Intestate Estates

Where the Confirmation is required only in relation to the sale of a property, there are no other assets; a petition and bond are required.

Fees start from £1,200 plus vat and outlays

 

Full Executry Service

Testate Estates 

Estates where there is a legally valid Will appointing executor(s) and outlining beneficiaries  (under IHT thresholds)

We will meet with you in the first instance and discuss the estate in detail; ensuring that we have appropriate information to allow us to proceed.  We will arrange for registration of the Will; contact all asset holders to ascertain the value of the estate; we will prepare and lodge Confirmation and Inventory;  we will provide the certificates to any asset holders, settle any debts, ingather the estate; prepare final accounting for Executor approval and arrange for distribution to the appropriate beneficiaries

Fees starting from £2,500 plus vat and outlays

Typical outlays

Registration dues of Will:  £20

Sheriff Court Confirmation dues: 

Up to £50,000  no charge

£50,000 – £250,000 – £341

Exceeding £250,000 – £684

Cost per certificate:  £9

Intestate Estates

Estates where there is no Will

(under IHT thresholds)

We will meet with you in the first instance and discuss the estate in detail; ensuring that we have appropriate information to allow us to proceed.   We will Petition the Court to have the appropriate person appointed as Executor; we will then prepare the Bond of Caution (which is a type of insurance policy required in intestate estates); thereafter we will contact all asset holders to ascertain the value of the estate; we will prepare and lodge Confirmation and Inventory; we will provide the certificates to any asset holders, settle any debts, ingather the estate; prepare final accounting for Executor approval and arrange for distribution to the appropriate beneficiaries

Fees starting from:  £3,500 plus vat and outlays

Typical outlays: 

Scottish Court Service Petition dues – £22

Bond of Caution (dependent on amount of estate) Starting at £190.00

Sheriff Court Confirmation dues: 

Up to £50,000  no charge

£50,000 – £250,000 – £341

Exceeding £250,000 – £684

Cost per certificate:  £9

A Bond of Caution is only required in intestate estates (where the deceased died without making a Will).  A Bond of Caution is not required where the value of the estate is less than £36,000 or; where the estate passes in its entirety to a surviving spouse or Civil partner.  

As you will appreciate, no two estates are the same and as such we will from time to time require to adjust our fee, we will of course advise you immediately if we require to do so.  

For example, if the estate is complicated and requires additional work, such as Requirements of Writing Application, asset searches, beneficiary searches; family dispute,  dispute in relation to the validity of the Will; deed of variation etc then we would require to adjust our fee.  

It is also open to you to request that your file be audited by the Auditor of Court who will assess your file and produce a certificate of fee for the work undertaken.
