Glasgow Law Practice White

Practice made perfect

By Stephen Smith, Employment Lawyer

STAFF in Glasgow employed by telecoms giant 02 have been told their terms and conditions will be unchanged for at least two years when they transfer to new employers.

Hundreds of staff will move to Capita next month while others are opting to take redundancy packages rather than remain.

Under the TUPE rules, the employees are entitled to transfer under the same terms but there was uncertainty about how long they will continue to be paid the same rate and work the same hours.

Now O2’s owners Telefonica have announced it will be 2015 at the earliest before any changes take effect. However, they are also offering voluntary redundancy packages as well, with staff being asked to sign compromise agreements if they opt for these, limiting their right to pursue any kind of legal action.
