Bullying & Sexual Harassment at Work

Bullying or harassment can be between two individuals or it may involve groups of people. It might be obvious or it might be insidious. Similar to discrimination, it is related to age, sex, race, ethnicity, nationality, disability, religion, belief or sexual orientation and may be persistent or an isolated incident. It can also occur in written communications, by phone, or email - not just face-to-face interactions.

Employees may not always feel able or confident enough to complain, particularly if the harasser is a manager or senior executive. Sometimes they will simply resign. It is therefore very important that employers ensure that staff are aware of options available to them to deal with potential bullying or harassment, and that these remain confidential.

Employees can be harassed by third parties, such as customers or clients. Where possible an employer should ensure their employees feel they are protected from such harassment and will take steps to deal with any situations which arise.

Employers are under a duty to ensure that all employees understand that bullying is not acceptable, and will result in disciplinary action being taken against the bully. Failing to deal with bullying in the correct manner will leave an employer open to a claim at the Employment Tribunal or in court.
