Social Work Investigation Solicitor Glasgow

Social work investigation Solicitor Glasgow

Social workers may become engaged in children’s lives because they believe it is necessary to protect and promote the child’s wellbeing. Other public bodies, such as schools or health services, may refer issues to social work. It is sometimes claimed that abuse or neglect endangers a child’s well-being.

Social workers can conduct child protection investigations and may request a Child Protection Order. This is an emergency order issued by a sheriff that permits social workers to take a child from their home.

For families, this may be an extremely stressful situation. The legal rights and obligations of both parents and social workers can be quite complex. At times like this, good legal guidance may be invaluable. Contact The Glasgow Law Practice today.

According to Article 8 of the European Convention on Human Rights, you have the right to a family life, which should not be interfered with by social services or the Children’s Hearing unless essential.

If there is an ongoing inquiry in your family’s life, you should seek immediate legal advice. The Social Work Department can convene a Child Protection Case Conference and enter a child’s name on the child protection register. If the recommendation is sustained, you will be invited to a Children’s Hearing. If you have been invited to a hearing or have continuous social work engagement with your children, seek immediate legal advice from The Glasgow Law Practice and our dedicated child protection lawyers.

Children Hearing Panel

A children’s hearing is a meeting of three Panel members to hear a child’s case. Each hearing must include one man and one woman, with one of the Panel members serving as chairman. The chairperson’s responsibility is to clarify what processes must be followed. Cases in the Children’s Panel are often referred by a person known as the Reporter.

When a referral is made, the Children’s Reporter has specific investigative powers, and social workers and police officers are required to provide information to the Children’s Reporter if obligatory measures of monitoring are required about a child.

At the Children’s Hearing, the panel will meet the child, family and any other parties that are due to give evidence. They will talk about the circumstances and issues involved.

If the panel determines that there is no requirement for compulsory supervision measures, then the case is at an end, and the referral is discharged.

Alternatively, the panel can make a compulsory supervision order. It will set out what measures of supervision are required. It will confirm what steps the social worker or family must take. They may make a decision about where a child has to live, who they will have contact with and when.
