Education Law and School Placing Requests
In Scotland, you can contest the Education Authority’s decision to deny your child a seat in your preferred school. The Education (Scotland) Act 1980, which governs this subject, has an underlying aim to prioritise parental choice. As a result, the measure is commonly known as the “Parents’ Charter”.
Education authorities are also responsible for providing education that aims to fully develop your child’s personality, talents, and physical ability. If the youngster wants to offer their opinion, it must be considered.
The Education Authority is prohibited from refusing a placement request unless one or more of the statutory grounds are present. Even in circumstances where the grounds can be shown to exist, the Sheriff Court has the authority to override these considerations, focus on the child’s unique needs, and order that the child be offered a place at the school of choice.
If your placement request is refused, the local council must explain why. If you disagree with their decision, you can appeal to the council’s Education Appeal Committee (EAC). You will have 28 days to file your appeal, beginning on the day you get the refusal letter, and you may do so online using the council’s form.
