Family member arrested and in Police Custody
Has a member of your family been arrested? Are they in a Police Station?
- All persons accused of an offence and detained in custody will be asked if they wish a Solicitor of their choice advised of their detention.
- Often people do not know or cannot remember a Solicitors details.
- In that event they will be offered the option of having a Duty Solicitor contacted. The accused person has no choice over who that Duty Solicitor is.
- In Glasgow the Duty Solicitor is very often from the Public Defence Solicitors Office. This is a Government run Solicitors office.
Can I assist and obtain a Solicitor for a family member?
Yes. You should immediately contact the Police Station where the accused person is detained and ask to speak with the Duty officer. You should advise that you wish to obtain your own Solicitor to represent the accused. You should provide details of that Solicitor i.e. The Glasgow Law Practice.
It is often presented to an accused person that they must use the Duty Solicitor. This is not correct. The Police may say that a Duty Solicitor has already been advised however you should make it clear you wish a Solicitor of choice notified.
A Solicitor cannot simply turn up at a Police Station to represent an accused. The accused needs to request a specific Solicitor or firm. Once a Solicitor is requested they are free to attend and meet the accused at the Police Station.
