
Drunk In Charge
It is an offence under section 5(1)(b) of the Road Traffic Act if a person is in charge of a motor vehicle on a road or other public place after consuming so much alcohol that the proportion of it in his/her breath, blood or urine exceeds the prescribed limit. However, it is a defence for a person to prove that at the time of the offence, the circumstances were such that there was no likelihood of driving the vehicle whilst the proportion of alcohol in their system remained likely to exceed the prescribed limit. If convicted, the Court can either endorse an offender’s licence with ten penalty points or impose a period of disqualification.
